                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, prohibiting the presence of radar detectors in a
     3     motor vehicle used to transport school children.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 4554.  Presence of radar detectors in a motor vehicle used to
     9             transport school children.
    10     (a)  Prohibition.--No radar detector may be present in a
    11  motor vehicle used to transport children to or from school or in
    12  connection with school activities, which is not a school bus
    13  because of its limited seating capacity and which is owned by or
    14  under contract with any school district or parochial or private
    15  school, during any period while the motor vehicle is being used
    16  to transport children to or from school or in connection with
    17  school activities.


     1     (b)  Forfeiture.--The provisions of this section shall not be
     2  construed as authorizing the seizure or forfeiture of a radar
     3  detector, unless otherwise provided by law.
     4     (c)  Definition.--As used in this section, the term "radar
     5  detector" means any device or mechanism to detect the emission
     6  of radio microwaves, laser beams or any other future speed
     7  measurement technology employed by law enforcement personnel to
     8  measure the speed of motor vehicles upon public roads and
     9  highways for enforcement purposes.
    10     Section 2.  This act shall take effect in 60 days.
