AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for windshield obstructions and 3 wipers and for issuance of inspection certificates. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 4524(e)(2)(i) and (3)(i) of Title 75 of 7 the Pennsylvania Consolidated Statutes are amended and the 8 section is amended by adding a subsection to read: 9 § 4524. Windshield obstructions and wipers. 10 * * * 11 (e) Sun screening and other materials prohibited.-- 12 * * * 13 (2) This subsection does not apply to: 14 (i) A vehicle which is equipped with tinted windows 15 of the type and specification that were installed by the 16 manufacturer of the vehicle or to any hearse, ambulance, 17 government vehicle [or any other vehicle for which a 18 currently valid certificate of exemption has been issued
1 in accordance with regulations adopted by the 2 department]. 3 * * * 4 (3) A certificate of exemption shall be issued by the 5 department for a vehicle which is: 6 [(i) Registered in this Commonwealth on the 7 effective date of this subsection and is equipped with a 8 sun screening device or other material prohibited under 9 paragraph (1) on the effective date.] 10 * * * 11 (g) Penalty.-- 12 (1) The following apply to subsection (e): 13 (i) Except as set forth in subparagraph (ii), an 14 individual who violates subsection (e) commits a summary 15 offense and shall, upon conviction, be sentenced to pay a 16 fine of $300 or to imprisonment for not more than 90 17 days, or both. 18 (ii) An individual who, after being sentenced under 19 subparagraph (i), violates subsection (e) commits a 20 misdemeanor of the third degree and shall, upon 21 conviction, be sentenced to pay a fine of $2,500 or to 22 imprisonment for not more than one year, or both. 23 Section 2. Section 4727(b) of Title 75 amended to read: 24 § 4727. Issuance of certificate of inspection. 25 * * * 26 (b) Requirements for issuance of certificate.--An official 27 certificate of inspection shall not be issued unless the vehicle 28 or mass transit vehicle is inspected and found to be in 29 compliance with the provisions of this chapter, including any 30 regulations promulgated by the department and in compliance with 20040H2743B4136 - 2 -
1 section 4524(e) (relating to windshield obstructions and 2 wipers). Notation of the odometer reading shall be included on 3 any certificate of inspection or other document as specified in 4 department regulations. 5 * * * 6 Section 3.
