AN ACT 1 Amending the act of June 14, 1961 (P.L.324, No.188), entitled 2 "An act relating to the establishment, operation and 3 maintenance of the State Library and public libraries in the 4 Commonwealth; amending, revising, consolidating and changing 5 the laws relating thereto; imposing duties upon public 6 officers; providing for State and local cooperation and 7 assistance in the establishment and maintenance of libraries; 8 prescribing penalties; and repealing existing laws," 9 providing for fiscal year waiver of standards AND FOR STATE <-- 10 AID FOR 2004-2005. 11 The General Assembly of the Commonwealth of Pennsylvania 12 hereby enacts as follows: 13 Section 1. Section 103 heading and (a) of the act of June 14 14, 1961 (P.L.324, No.188), known as The Library Code, added 15 February 5, 2004, (P.L.59, No.6), are amended to read: 16 Section 103. [Fiscal Year 2003-2004] Waiver of Standards.-- 17 (a) If the Commonwealth's appropriation for libraries in fiscal 18 [year] years 2003-2004 and 2004-2005 is less than that provided 19 in fiscal year 2002-2003, the following conditions shall apply:
1 during the fiscal year beginning July 1, 2003, and ending June 2 30, 2004, and the fiscal year beginning July 1, 2004, and ending 3 June 30, 2005, the State Librarian may, upon application by the 4 board of directors of a local library, waive standards contained 5 in this act or regulations promulgated under this act relating 6 to hours of operation, continuing professional development, 7 collections expenditures and any other standards related to 8 library operations deemed appropriate by the State Librarian. 9 * * * 10 Section 2. This act shall take effect immediately. <-- 11 SECTION 2. THE ACT IS AMENDED BY ADDING A SECTION TO READ: <-- 12 SECTION 303.14. STATE-AID FOR 2004-2005.--NOTWITHSTANDING 13 ANY PROVISION OF LAW TO THE CONTRARY, EACH LIBRARY SHALL BE 14 ELIGIBLE FOR STATE-AID FOR FISCAL YEAR 2004-2005 TO BE 15 CALCULATED AS FOLLOWS: 16 (1) ANY DISTRICT LIBRARY CENTER ESTABLISHED DURING FISCAL 17 YEAR 2003-2004 SHALL RECEIVE ONE HUNDRED AND TWENTY-SIX THOUSAND 18 DOLLARS ($126,000). 19 (2) ANY DISTRICT LIBRARY CENTER FROM WHOSE SERVICE AREA A 20 NEW DISTRICT LIBRARY CENTER WAS ESTABLISHED DURING FISCAL YEAR 21 2003-2004 SHALL RECEIVE THREE HUNDRED SEVENTEEN THOUSAND SIX 22 HUNDRED SIXTY-TWO DOLLARS ($317,662). 23 (3) ANY DISTRICT LIBRARY CENTER NOT QUALIFYING FOR FUNDING 24 UNDER CLAUSE (1) OR (2), SHALL RECEIVE THE AMOUNT THE LIBRARY 25 RECEIVED IN FISCAL YEAR 2003-2004 UNDER SECTION 303.13(1) 26 MULTIPLIED BY ONE HUNDRED TWENTY PERCENT (120%). 27 (4) ANY LIBRARY THAT RECEIVED FUNDING IN FISCAL YEAR 2003- 28 2004 UNDER SECTION 303.13(2) SHALL RECEIVE THE SAME AMOUNT 29 RECEIVED IN FISCAL YEAR 2003-2004. 30 (5) IF A LIBRARY RECEIVES FUNDING UNDER CLAUSE (4): 20040H2726B4321 - 2 -
1 (I) SUBTRACT THE SUM OF CLAUSES (1), (2), (3) AND (4) FROM 2 THE TOTAL APPROPRIATION AVAILABLE FOR THE IMPROVEMENT OF LIBRARY 3 SERVICES. 4 (II) MULTIPLY THE AMOUNT OF FUNDING THAT THE LIBRARY 5 RECEIVED IN FISCAL YEAR 2003-2004 UNDER SECTION 303.13(2) BY THE 6 DIFFERENCE FROM SUBCLAUSE (I) AND DIVIDE THAT PRODUCT BY THE SUM 7 OF THE AMOUNT OF FUNDING PROVIDED TO ALL LIBRARIES UNDER SECTION 8 303.13(2) IN FISCAL YEAR 2003-2004. 9 (6) ADD CLAUSES (1), (2), (3), (4) AND (5) TO DETERMINE THE 10 AMOUNT OF FUNDING. 11 SECTION 3.
