           GRUCELA, FREEMAN, KIRKLAND, FABRIZIO, BELARDI, LEDERER, CRUZ,
           BELFANTI, GOODMAN, JOSEPHS, SAYLOR, BISHOP, YOUNGBLOOD, COY,

                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, further providing for the duties of
     3     electric distribution companies.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 2807 of Title 66 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subsection to read:
     8  § 2807.  Duties of electric distribution companies.
     9     * * *
    10     (f)  Maintaining distribution and transmission service
    11  quality.--
    12         (1)  The commission shall adopt such orders, secretarial
    13     letters, regulations and enforcement actions as necessary and
    14     appropriate to assure that each electric distribution company
    15     provides distribution and transmission service at a level of
    16     performance that meets or exceeds that provided as of January
    17     1, 1997.


     1         (2)  The commission shall publish and release to the
     2     public on or before September 1 of each year a report
     3     providing such information and analyses as necessary and
     4     appropriate for the commission to certify as to each electric
     5     distribution company that during the prior calendar year,
     6     each electric distribution company did or did not provide
     7     distribution and transmission service equal to or better than
     8     that provided as of January 1, 1997. The report shall:
     9             (i)  Identify any material aspects of the reliability
    10         performance of each electric distribution company that
    11         exceed that provided as of January 1, 1997.
    12             (ii)  Identify any material deficiency in the
    13         reliability performance of each electric distribution
    14         company that fails to meet that provided as of January 1,
    15         1997.
    16             (iii)  The steps that each electric distribution
    17         company has taken to correct any such deficiency.
    18             (iv)  The orders or other steps taken by the
    19         commission to assure that reliable distribution and
    20         transmission service equal to or better than that
    21         provided on January 1, 1997, shall be provided by each
    22         electric distribution company.
    23         (3)  The commission shall require each electric
    24     distribution company to file on or before May 31 of each year
    25     a public report on the reliability of its distribution and
    26     transmission service during the prior calendar year,
    27     including, but not limited to:
    28             (i)  A detailed description of distribution and
    29         transmission facilities in service, retired from service
    30         during the report year and planned additions for the

     1         postreport year.
     2             (ii)  The dollar value for capital investment,
     3         inspection, tree trimming, maintenance and other
     4         transmission and distribution system reliability
     5         operations in rates, as budgeted and actual expenditures.
     6             (iii)  The number and cost of employees and
     7         contractors responsible for maintaining and restoring
     8         transmission and distribution service in rates, as
     9         budgeted and actual.
    10             (iv)  The number of momentary and sustained service
    11         disruptions, the number of customers affected and the
    12         duration of each service disruption.
    13             (v)  The cause of each service disruption, including
    14         the number and percentage of events and customers
    15         affected due to weather, animal contact, equipment
    16         failure, equipment deterioration, lack of adequate
    17         facilities, human error and other causes.
    18             (vi)  Descriptions and explanations of the company
    19         capital investment, inspection, maintenance, tree
    20         trimming and other programs and plans that affect service
    21         quality performance, changes from the report year to the
    22         prior or next year, and the relationship of such plans to
    23         the information provided in the report and the ability of
    24         the company to provide distribution and transmission
    25         service at or exceeding the level provided on January 1,
    26         1997.
    27     Section 2.  This act shall take effect immediately.
