AN ACT
1 Amending Title 71 (State Government) of the Pennsylvania
2 Consolidated Statutes, further regulating termination of
3 annuities.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 5301(d) of Title 71 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 5301. Mandatory and optional membership.

10 (d) Return to service.--An annuitant who returns to service
11 as a State employee shall resume active membership in the system
12 as of the effective date of employment, except as otherwise
13 provided in section [5706(a)] 5706(a) and (d) (relating to
14 termination of annuities), regardless of the optional membership
15 category of the position.
1 * * * 2 Section 2. Section 5706 of Title 71 is amended by adding a 3 subsection to read: 4 § 5706. Termination of annuities. 5 * * * 6 (d) Exception.--An annuitant may return to State service as 7 a certified instructor in the Municipal Police Officers' 8 Education and Training Program, as provided in 53 Pa.C.S. § 2161 9 (relating to establishment of program and scope of subchapter), 10 without being subject to the cessation of annuity provisions in 11 subsection (a), provided that the annuitant shall not receive 12 credit for such service and further provided that no member 13 contributions nor employer contributions shall be credited to 14 the annuitant's savings account for service authorized under 15 this subsection. 16 Section 3.
