        AS REPORTED FROM COMMITTEE ON HEALTH AND HUMAN SERVICES, HOUSE
           OF REPRESENTATIVES, AS AMENDED, SEPTEMBER 24, 2003

                                     AN ACT

     1  Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An
     2     act to consolidate, editorially revise, and codify the public
     3     welfare laws of the Commonwealth," providing for personal
     4     needs allowance deduction for medical assistance eligible
     5     persons in nursing facilities.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The act of June 13, 1967 (P.L.31, No.21), known
     9  as the Public Welfare Code, is amended by adding a section to
    10  read:
    11     Section 443.7.  Personal Needs Allowance Deduction for
    12  Medical Assistance Eligible Persons in Nursing Facilities.--(a)
    13  A personal needs allowance of not less than forty dollars ($40)
    14  per month, for clothing and other personal needs, shall be

     1  deducted from a medical assistance eligible person's gross
     2  income, as defined by departmental regulation, for purposes of
     3  determining the amount that person must pay toward the cost of
     4  skilled health care and intermediate services or intermediate
     5  care while residing in a nursing facility.
     6     (b)  The personal needs allowance under subsection (a) shall
     7  be increased to forty dollars ($40) beginning July 1, 2003. BE    <--
     8  INCREASED TO NOT LESS THAN FORTY-FIVE DOLLARS ($45) BEGINNING
     9  JULY 1, 2007.
    10     Section 2.  Any regulations or parts of regulations are
    11  hereby abrogated to the extent of any inconsistency with this
    12  act.
    13     Section 3.  This act shall take effect in 90 days.
