                                     AN ACT

     1  Amending the act of November 24, 1998 (P.L.874, No.110),
     2     entitled "An act relating to the unlawful disposition of
     3     motor vehicles; and providing penalties," further providing
     4     for the definition of "chop shop."

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 2 of the act of November 24, 1998
     8  (P.L.874, No.110), known as the Motor Vehicle Chop Shop and
     9  Illegally Obtained and Altered Property Act, is amended to read:
    10  Section 2.  Definitions.
    11     The following words and phrases when used in this act shall
    12  have the meanings given to them in this section unless the
    13  context clearly indicates otherwise:
    14     "Chop shop."  Any building, lot or other premises where one
    15  or more persons engage in altering, destroying, disassembling,
    16  dismantling, reassembling, storing or possessing any motor


     1  vehicle or motor vehicle part known [by such person or persons
     2  to be illegally obtained] to be illegally obtained by theft,
     3  fraud or conspiracy to defraud in order to either:
     4         (1)  alter, counterfeit, deface, destroy, disguise,
     5     falsify, forge, obliterate or remove the identification,
     6     including the vehicle identification number of the motor
     7     vehicle or motor vehicle part, in order to misrepresent the
     8     identity of the motor vehicle or motor vehicle part or to
     9     prevent the identification of the motor vehicle or motor
    10     vehicle part; or
    11         (2)  sell or dispose of the motor vehicle or motor
    12     vehicle part.
    13     "Motor vehicle."  A vehicle which is self-propelled except
    14  one which is propelled solely by human power or by electric
    15  power obtained from overhead trolley wires but not operated upon
    16  rails.
    17     "Person."  A natural person, firm, copartnership, association
    18  or corporation.
    19     "Vehicle identification number."  A combination of numerals
    20  or letters, or both, which the manufacturer assigns to a vehicle
    21  for identification purposes or, in the absence of a manufacturer
    22  assigned number, which the Department of Transportation assigns
    23  to a vehicle for identification purposes.
    24     Section 2.  This act shall take effect in 60 days.
