AN ACT
1 Amending Title 27 (Environmental Resources) of the Pennsylvania
2 Consolidated Statutes, further defining "waste transportation
3 vehicle" relating to waste transportation safety.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. The definition of "waste transportation vehicle"
7 in section 6202 of Title 27 of the Pennsylvania Consolidated
8 Statutes is amended to read:
9 § 6202. Definitions.
10 The following words and phrases when used in this chapter
11 shall have the meanings given to them in this section unless the
12 context clearly indicates otherwise:

14 "Waste transportation vehicle." Public and private motor
15 carrier vehicles and waste trailers, as defined in this chapter,
16 [regularly used in] the primary use of which is transporting
17 municipal or residual waste to a processing or disposal facility
18 in this Commonwealth. ANY SUCH VEHICLE OR TRAILER THAT <--
1 TRANSPORTS MUNICIPAL OR RESIDUAL WASTE FROM A TRANSFER STATION
2 TO A PROCESSING OR DISPOSAL FACILITY OR FROM ONE PROCESSING OR
3 DISPOSAL FACILITY TO ANOTHER SHALL BE CONSIDERED AS PRIMARILY
4 USED FOR TRANSPORTING MUNICIPAL OR RESIDUAL WASTE. The term does
5 not include vehicles currently registered by the department
6 pursuant to 25 Pa. Code § 285.225 (relating to transportation of
7 residential septage) or consumer product delivery trucks. <--
8 Section 2. This act shall take effect in 60 days.
