        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           MAY 13, 2003

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for the offense of
     3     scattering rubbish.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6501(b)(1) AND (D)(1) of Title 18 of the   <--
     7  Pennsylvania Consolidated Statutes is ARE amended to read:        <--
     8  § 6501.  Scattering rubbish.

    10     (b)  Penalty.--
    11         (1)  A person who violates subsection (a)(1) or (2) is
    12     guilty of a summary offense for the first offense and upon
    13     conviction thereof shall be sentenced to:
    14             (i)  pay a fine of not less than [$50] $250 nor more
    15         than [$300] $500 [or to];
    16             (ii)  imprisonment for not more than 90 days[, or

     1         both.];
     2             (iii)  not more than 90 days of community service; or
     3             (iv)  any combination of subparagraphs (i), (ii) and
     4         (iii).

     6     (D)  FORFEITURE.--                                             <--
     7         (1)  PROPERTY SUBJECT TO FORFEITURE UNDER THIS SECTION
     8     MAY BE SEIZED BY THE LAW ENFORCEMENT AUTHORITY UPON PROCESS
     9     ISSUED BY ANY COURT OF COMMON PLEAS HAVING JURISDICTION OVER
    10     THE PROPERTY. WHEN A WASTE TRANSPORTATION VEHICLE OR A WASTE
    11     TRAILER REGULATED UNDER 27 PA.C.S. § 6204 (RELATING TO WASTE
    12     TRANSPORTATION SAFETY PROGRAM) IS FORFEITED IN ACCORDANCE
    13     WITH THIS SECTION, THE DEPARTMENT OF ENVIRONMENTAL PROTECTION
    14     SHALL BE NOTIFIED AND IT SHALL CONDUCT A COMPLIANCE HISTORY
    15     REVIEW OF THE WASTE TRANSPORTER.

    17     Section 2.  This act shall take effect in 60 days.
