                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for gambling
     3     devices.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 5513(c) of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 5513.  Gambling devices, gambling, etc.
     9     * * *
    10     (c)  Antique slot machines.--
    11         (1)  A slot machine shall be established as an antique
    12     slot machine if the defendant shows by a preponderance of the
    13     evidence that it was manufactured at least [25] 20 years
    14     before the current year and that it was not used or attempted
    15     to be used for any unlawful purposes. Notwithstanding
    16     subsection (b), no antique slot machine seized from any
    17     defendant shall be destroyed or otherwise altered until the
    18     defendant is given an opportunity to establish that the slot

     1     machine is an antique slot machine. After a final court
     2     determination that the slot machine is an antique slot
     3     machine, the slot machine shall be returned pursuant to the
     4     provisions of law providing for the return of property;
     5     otherwise, the slot machine shall be destroyed.
     6         (2)  It is the purpose of this subsection to protect the
     7     collection and restoration of antique slot machines not
     8     presently utilized for gambling purposes.

    10     Section 2.  This act shall take effect in 60 days.
