                                     AN ACT

     1  Amending Title 53 (Municipalities Generally) of the Pennsylvania
     2     Consolidated Statutes, further providing for municipal powers
     3     on public improvements; and making an appropriation.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 5403 of Title 53 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a paragraph to read:
     8  § 5403.  Powers of governing body.
     9     The governing body of every municipal corporation shall have
    10  the power:
    11         * * *
    12         (6)  To enact a resolution or ordinance providing for
    13     independent testing of sewage sludge on reclamation sites. If
    14     the resolution or ordinance requires testing on reclamation
    15     sites, it must provide that the first two tests shall be paid
    16     for by the Department of Environmental Protection as long as


     1     the appropriation to the department for sewage sludge tests
     2     has not been exhausted. The resolution or ordinance shall
     3     also provide that sewage sludge testing conducted under this
     4     paragraph and not paid for by the department under this
     5     paragraph shall be at the sole expense of the municipal
     6     corporation.
     7     Section 2.  The sum of $500,000, or as much thereof as may be
     8  necessary, is appropriated to the Department of Environmental
     9  Protection for the fiscal year July 1, 2002, to June 30, 2003,
    10  to fund sewage sludge testing under 53 Pa.C.S. § 5403(6).
    11     Section 3.  This act shall take effect in 60 days.
