                                     AN ACT

     1  Providing for lead-level testing of playgrounds, schools and
     2     parks; and making an appropriation.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Lead-Level
     7  Testing Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Department."  The Department of Health of the Commonwealth.
    13     "Risk area."  Any of the following:
    14         (1)  A playground.
    15         (2)  A public, private or parochial elementary or


     1     secondary school.
     2         (3)  A public park.
     3  Section 3.  Testing and reporting.
     4     (a)  Testing.--The department shall test the paint in risk
     5  areas to determine the presence and levels of lead in paint. The
     6  department shall schedule testing so that all risk areas in this
     7  Commonwealth are tested within five years.
     8     (b)  Report.--The department shall publish in the
     9  Pennsylvania Bulletin an annual report of the testing under
    10  subsection (a).
    11  Section 4.  Appropriation.
    12     The sum of $   , or as much thereof as may be necessary, is
    13  hereby appropriated to the Department of Health for the fiscal
    14  year July 1, 2003, to June 30, 2004, to carry out the provisions
    15  of this act.
    16  Section 5.  Effective date.
    17     This act shall take effect in 60 days.
