                                     AN ACT

     1  Requiring the Department of General Services to establish energy
     2     profiles for certain State buildings.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Energy
     7  Profile for State Buildings Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Department."  The Department of General Services of the
    13  Commonwealth.
    14     "Energy profile."  A document, as described in section 3,
    15  showing the types and rates of energy consumed and the amount of
    16  dollars expended for energy consumption in a State building.
    17     "State building."  A structure occupied by an executive

     1  agency as defined in 62 Pa.C.S. § 103 (relating to definitions).
     2  Section 3.  Energy profiles for State buildings.
     3     (a)  Establishment.--The department shall establish an energy
     4  profile for each State building.
     5     (b)  Content.--The energy profile established in subsection
     6  (a) shall include, but not be limited to, the following
     7  information for the State building:
     8         (1)  The source of electric generation, including the
     9     type of generation.
    10         (2)  The source of heating fuel, including the type of
    11     fuel.
    12         (3)  The size of the building as measured in square feet.
    13         (4)  The total expenditures per month for electricity and
    14     heating fuel.
    15         (5)  The total amount of British thermal units per month.
    16         (6)  The total amount of Btu's per month per square foot.
    17         (7)  The total expenditures per month per square foot.
    18  Information shall be reported for the current month and the
    19  preceding six months and shall clearly indicate the additional
    20  utility costs or the cost savings from the immediate past month
    21  to the current month as well as any cumulative costs or cost
    22  savings for the fiscal year.
    23     (c)  Posting.--The department shall post the energy profile
    24  for a State building in a location accessible to the general
    25  public during normal business hours and shall post the energy
    26  profile for the State building on the department's World Wide
    27  Web site.
    28     (d)  Public record.--An energy profile shall be deemed a
    29  public record and subject to the provisions of the act of June
    30  21, 1957 (P.L.390, No.212), referred to as the Right-to-Know

     1  Law.
     2     (e)  Review and regulations.--The department shall annually
     3  review the provisions of this act to determine if additional
     4  information shall be required to be included on each profile.
     5  The department shall have the authority to promulgate rules and
     6  regulations necessary to implement the provisions of this act.
     7  Section 4.  Effective date.
     8     This act shall take effect July 1, 2003.
