A CONCURRENT RESOLUTION 1 Directing the Joint State Government Commission to establish a 2 bipartisan task force with an advisory committee to complete 3 the codification of Pennsylvania's law on real property and 4 to review and update the law on real property on a continuing 5 basis. 6 WHEREAS, Codification is the process of revising and 7 restating the general and permanent public statutes into a 8 concise code of law that is clear, consistent and organized; and 9 WHEREAS, Codification is necessary because session laws that 10 are drafted to address a specific purpose have an impact on 11 other statutory rights and obligations in ways that are not 12 always anticipated; and 13 WHEREAS, Statutes which are inconsistent, redundant and 14 ambiguous may be misinterpreted; and 15 WHEREAS, Title 68 of the Pennsylvania Consolidated Statutes 16 (Real and Personal Property) has been only partially codified; 17 and 18 WHEREAS, On the recommendation of its Real Property, Probate 19 and Trust Section, the Pennsylvania Bar Association adopted a
1 resolution urging the Joint State Government Commission to 2 complete the codification process on the subject of real 3 property law; and 4 WHEREAS, Numerous legislative proposals are before the 5 General Assembly each session addressing substantive and 6 technical concerns with Pennsylvania's real property law; and 7 WHEREAS, Real property law is an important area of 8 substantive law that should be reviewed and updated on a 9 continuing basis; therefore be it 10 RESOLVED (the House of Representatives concurring), That the 11 General Assembly direct the Joint State Government Commission to 12 undertake an ongoing study of Pennsylvania's law on real 13 property, codifying and updating the law; and be it further 14 RESOLVED, That to accomplish this goal, a task force be 15 created consisting of two members appointed by the President pro 16 tempore of the Senate, two members appointed by the Minority 17 Leader of the Senate, two members appointed by the Speaker of 18 the House of Representatives and two members appointed by the 19 Minority Leader of the House of Representatives; and be it 20 further 21 RESOLVED, That the task force create an advisory committee 22 composed of experts on real property law; and be it further 23 RESOLVED, That the task force and advisory committee complete 24 the codification of Pennsylvania's law on real property and 25 review and update the law on real property on a continuing 26 basis; and be it further 27 RESOLVED, That the task force and advisory committee from 28 time to time present its findings and recommended legislation to 29 the General Assembly.
