                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, further providing for eligibility for
     3     paralyzed veteran's pension.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 7702 of Title 51 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 7702.  Paralyzed veteran's pension.
     9     (a)  Amount and eligibility.--In addition to any other
    10  assistance provided by the Commonwealth and in addition to any
    11  compensation provided by the Federal Government, every paralyzed
    12  veteran shall be paid a pension of $150 per month. Applications
    13  for the pensions shall be made to and in the form prescribed by
    14  the department. The Adjutant General shall determine the
    15  eligibility of every applicant for a pension, and his decision
    16  in the matter shall be final.
    17     (b)  Regulations.--The Adjutant General shall promulgate such


     1  regulations as may be necessary to implement this program.
     2     (c)  Definition.--As used in this section the term "paralyzed
     3  veteran" means any person who served in the military or naval
     4  forces of the United States, or any woman's organization
     5  officially connected therewith, [during an established war or
     6  armed conflict service dates,] and who gave this Commonwealth as
     7  [his] that person's place of residence at the time of entering
     8  the military or naval forces of the United States [and is
     9  currently a resident of this Commonwealth] and who, while
    10  performing duties connected with [that] such service, suffered
    11  an injury or incurred a disease which resulted in the loss or
    12  loss of use of two or more extremities. The term does not
    13  include any person separated from the military or naval forces
    14  of the United States, or any woman's organization officially
    15  connected therewith, under other than honorable conditions. The
    16  term shall include [persons who have] any person who has been
    17  paralyzed as a result of peacetime combat-related actions as
    18  defined by the Department of Military Affairs. The department
    19  shall, by regulation, establish criteria to determine
    20  eligibility based on participation in a peacetime combat-related
    21  situation, which shall include, but not be limited to, hostile
    22  fire or terrorist attack.
    23     Section 2.  This act shall take effect July 1, 2001, or
    24  immediately, whichever occurs later.
