                                     AN ACT

     1  Establishing annual performance standards for the provision of
     2     alcohol and drug abuse and dependency treatment.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Alcohol and
     7  Drug Abuse and Dependency Treatment Standards Act.
     8  Section 2.  Definitions.


     1     The following words and phrases when used in this act shall
     2  have the meanings given to them in this section unless the
     3  context clearly indicates otherwise:
     4     "Carrier."  The term means any of the following:
     5         (1)  A health insurer.
     6         (2)  A nonprofit health service plan.
     7         (3)  A health maintenance organization.
     8         (4)  A preferred provider organization.
     9         (5)  A third-party administrator.
    10         (6)  Any other entity that provides health benefit plans
    11     subject to regulation by the Commonwealth.
    12  Section 3.  Required annual plan.
    13     All carriers and health plans doing business in this
    14  Commonwealth shall submit an annual alcohol and drug abuse and
    15  dependency treatment plan which shall include, but not be
    16  limited to:
    17         (1)  An estimate of prevalence of chemical dependency in
    18     the subscriber pool.
    19         (2)  An estimate of the need for each type of alcohol and
    20     other drug abuse and addiction treatment service and lengths
    21     of stay in each year.
    22         (3)  A follow-up plan to ensure continuing care.
    23         (4)  An outreach plan setting goals to increase
    24     identification and treatment of subscribers with alcohol and
    25     other drug problems, methods of access to assessment and
    26     treatment displaying timeliness and appropriateness for
    27     handling alcohol and other drug-affected individuals.
    28         (5)  A proposed addiction treatment program network
    29     demonstrating the full continuum of care, geographic
    30     availability, cultural sensitivity and planning for special

     1     needs populations.
     2         (6)  A method to provide measures of performance within
     3     each of these categories.
     4         (7)  An annual assessment of success in meeting each goal
     5     established in the plan.
     6  Section 4.  Review of plans.
     7     All plans submitted under section 3 shall be reviewed and
     8  approved or disapproved within 90 days by the Insurance
     9  Department and the Department of Health, Bureau of Drug and
    10  Alcohol Programs and the Bureau of Managed Care.
    11  Section 5.  Report of plan reviews.
    12     Copies of the review performed in section 4 shall be
    13  submitted to the Health Care Unit of the Office of Attorney
    14  General, the Public Health and Welfare Committee of the Senate
    15  and the Health and Human Services Committee of the House of
    16  Representatives and made available to the public.
    17  Section 6.  Effective date.
    18     This act shall take effect July 1, 2002.
