AN ACT 1 Amending Title 42 (Judiciary and Judicial Procedure) of the 2 Pennsylvania Consolidated Statutes, providing for fingerprint 3 fee. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Title 42 of the Pennsylvania Consolidated 7 Statutes is amended by adding a section to read: 8 § 1725.5. Fingerprint fee. 9 (a) Imposition.--A person who pleads guilty or nolo 10 contendere to or receives Accelerated Rehabilitative Disposition 11 or is convicted of a crime as defined in 18 Pa.C.S. § 106 12 (relating to classes of offenses) and has fingerprints taken 13 pursuant to 18 Pa.C.S. § 9112 (relating to mandatory 14 fingerprinting), 3929 (relating to retail theft) or 3929.1 15 (relating to library theft) shall, in addition to any fines, 16 penalties or costs, pay a fingerprint fee which shall include, 17 but is not limited to, the actual cost of having the
1 fingerprints taken. 2 (b) Amount of fee.--The director of the unit of a criminal 3 justice agency which took the fingerprints shall determine the 4 actual cost of the fingerprint services provided and shall 5 transmit a statement of services rendered to the court. The 6 court may set the fee at an amount above the actual cost. 7 (c) Disposition of fees.--Fees collected pursuant to this 8 section shall be used solely for the operation and maintenance 9 of fingerprint services provided by a criminal justice agency. 10 (d) Other laws.--The fingerprint fee shall be imposed 11 notwithstanding any other provision of law to the contrary. 12 (e) Definition.--As used in this section, the term "criminal 13 justice agency" shall have the same meaning given to it in 18 14 Pa.C.S. § 9102 (relating to definitions). 15 Section 2.
