                                     AN ACT

     1  Requiring background checks of persons who coach youth athletic
     2     teams.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Background checks.
     6     (a)  Requirement.--A person who seeks to coach a youth
     7  athletic team which is organized and supervised by an
     8  association shall provide to the association a background check
     9  which reports whether the potential coach has a criminal or
    10  abusive history.
    11     (b)  Criminal history.--A potential coach, to satisfy the
    12  requirement of subsection (a) regarding criminal history, shall
    13  provide a report of criminal history record information from the
    14  Pennsylvania State Police or a statement from the Pennsylvania
    15  State Police that the Pennsylvania State Police central
    16  repository contains no such information relating to that person.
    17  Such criminal history record information shall be limited to


     1  that which is disseminated pursuant to 18 Pa.C.S. § 9121(b)(2)
     2  (relating to general regulations) and shall be no more than one
     3  year old.
     4     (c)  Abusive history.--A potential coach, to satisfy the
     5  requirement of subsection (a) regarding abusive history, shall
     6  provide an official clearance statement obtained from the
     7  Department of Public Welfare within the immediately preceding
     8  year as to whether the person is named as the individual
     9  responsible for injury or abuse in an indicated report or a
    10  founded report.
    11     (d)  File.--The association shall maintain a copy of the
    12  required information for so long as the person coaches for the
    13  association.
    14  Section 2.  Effective date.
    15     This act shall take effect in 60 days.
