AN ACT 1 Amending the act of May 17, 1921 (P.L.682, No.284), entitled "An 2 act relating to insurance; amending, revising, and 3 consolidating the law providing for the incorporation of 4 insurance companies, and the regulation, supervision, and 5 protection of home and foreign insurance companies, Lloyds 6 associations, reciprocal and inter-insurance exchanges, and 7 fire insurance rating bureaus, and the regulation and 8 supervision of insurance carried by such companies, 9 associations, and exchanges, including insurance carried by 10 the State Workmen's Insurance Fund; providing penalties; and 11 repealing existing laws," removing the time limitation on 12 certain prosthetic devices utilized during mastectomy 13 operations. 14 The General Assembly of the Commonwealth of Pennsylvania 15 hereby enacts as follows: 16 Section 1. Section 633(b) of the act of May 17, 1921 17 (P.L.682, No.284), known as The Insurance Company Law of 1921, 18 added November 4, 1997 (P.L.492, No.51), is amended to read:
1 Section 633. Mastectomy and Breast Cancer Reconstruction.--* 2 * * 3 (b) (1) Every health care policy which is delivered, issued 4 for delivery, renewed, extended or modified in this Commonwealth 5 by a health care insurer which provides coverage for the 6 surgical procedure known as mastectomy shall also include 7 coverage for prosthetic devices and reconstructive surgery 8 incident to any mastectomy. 9 (2) Coverage for prosthetic devices and reconstructive 10 surgery shall be subject to the deductible and coinsurance 11 conditions applied to the mastectomy and all other terms and 12 conditions applicable to other benefits. 13 [(3) The coverage for prosthetic devices inserted during 14 reconstructive surgery and reconstructive surgery pursuant to 15 this section may be limited to such surgical procedures 16 performed within six years of the date of the mastectomy.] 17 * * * 18 Section 2.
