                                     AN ACT

     1  Amending the act of December 20, 1985 (P.L.457, No.112),
     2     entitled "An act relating to the right to practice medicine
     3     and surgery and the right to practice medically related acts;
     4     reestablishing the State Board of Medical Education and
     5     Licensure as the State Board of Medicine and providing 16for
     6     its composition, powers and duties; providing for the
     7     issuance of licenses and certificates and the suspension and
     8     revocation of licenses and certificates; providing penalties;
     9     and making repeals," providing for suspension for failure to
    10     pay educational loans.

    11     The General Assembly of the Commonwealth of Pennsylvania
    12  hereby enacts as follows:
    13     Section 1.  The act of December 20, 1985 (P.L.457, No.112),
    14  known as the Medical Practice Act of 1985, is amended by adding
    15  a section to read:
    16  Section 40.1  Suspension for failure to pay educational loans.
    17     (a)  General rule.--The board shall suspend the license of a
    18  board regulated practitioner found to be in breach of a
    19  contractual obligation arising out of receipt of Federal or
    20  State funding for medical education.
    21     (b)  Administrative procedure.--Subsection (a) is subject to

     1  2 Pa.C.S. Ch. 5 Subch. A (relating to practice and procedure of
     2  Commonwealth agencies) and Ch. 7 Subch. A (relating to judicial
     3  review of Commonwealth agency action).
     4     (c)  Conditions for reinstatement.--The board shall
     5  immediately reinstate the license of a board regulated
     6  practitioner whose license is suspended under subsection (a) if
     7  any of the following apply:
     8         (1)  The board regulated practitioner is no longer in
     9     breach of the contractual obligation.
    10         (2)  The board regulated practitioner and the obligee
    11     have reached agreement regarding the breach of the
    12     contractual obligation.
    13         (3)  The board is satisfied that the board regulated
    14     practitioner is making sufficient progress toward satisfying
    15     the contractual obligation.
    16     Section 2.  This act shall take effect in 60 days.
