                                     AN ACT

     1  Amending Titles 42 (Judiciary and Judicial Procedure) and 53
     2     (Municipalities Generally) of the Pennsylvania Consolidated
     3     Statutes, providing for legislative security officers.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 8902 of Title 42 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subsection to read:
     8  § 8902.  Arrest without warrant.
     9     * * *
    10     (c)  Definition.--As used in this section, the term "police
    11  officer" includes an individual who is:
    12         (1)  employed by the House of Representatives as a
    13     legislative security officer; and
    14         (2)  specifically designated by the Bipartisan Management
    15     Committee to enforce the laws of this Commonwealth, including
    16     making arrests as provided by law for violations of the laws
    17     of this Commonwealth, on the premises and grounds of:
    18             (i)  the State Capitol Building;


     1             (ii)  a building where an office of a member or
     2         employee of the House of Representatives is located; and
     3             (iii)  a building where an official function,
     4         including a committee meeting or hearing, of the House of
     5         Representatives is being conducted.
     6     Section 2.  Section 8951 of Title 42 is amended by adding a
     7  definition to read:
     8  § 8951.  Definitions.
     9     The following words and phrases when used in this subchapter
    10  shall have, unless the context clearly indicates otherwise, the
    11  meanings given to them in this section:
    12     * * *
    13     "Police officer." Includes an individual who is:
    14         (1)  employed by the House of Representatives as a
    15     legislative security officer; and
    16         (2)  specifically designated by the Bipartisan Management
    17     Committee to enforce the laws of this Commonwealth, including
    18     making arrests as provided by law for violations of the laws
    19     of this Commonwealth, on the premises and grounds of:
    20             (i)  the State Capitol Building;
    21             (ii)  a building where an office of a member or
    22         employee of the House of Representatives is located; and
    23             (iii)  a building where an official function,
    24         including a committee meeting or hearing, of the House of
    25         Representatives is being conducted.

    27     Section 3.  The definition of "police officer" in section
    28  2162 of Title 53 is amended to read:
    29  § 2162.  Definitions.
    30     The following words and phrases when used in this subchapter

     1  shall have the meanings given to them in this section unless the
     2  context clearly indicates otherwise:
     3     * * *
     4     "Police officer."  Any full-time or part-time employee of a
     5  city, borough, town, township, railroad or street railway
     6  police, campus police or university police or county police
     7  department assigned to criminal or traffic law enforcement
     8  duties[;] and any deputy sheriff of a county of the second
     9  class[; and, for]. The following apply:
    10         (1)  For the purpose of training only, [security
    11     officers] the term includes all of the following:
    12             (i)  A security officer of a first class city housing
    13         authority.
    14             (ii)  An individual who is:
    15                 (A)  employed by the House of Representatives as
    16             a legislative security officer; and
    17                 (B)  specifically designated by the Bipartisan
    18             Management Committee to enforce the laws of this
    19             Commonwealth, including making arrests as provided by
    20             law for violations of the laws of this Commonwealth,
    21             on the premises and grounds of:
    22                     (I)  the State Capitol Building;
    23                     (II)  a building where an office of a member
    24                 or employee of the House of Representatives is
    25                 located; and
    26                     (III)  a building where an official function,
    27                 including a committee meeting or hearing, of the
    28                 House of Representatives is being conducted.
    29         (2)  The term excludes persons employed to check parking
    30     meters or to perform only administrative duties and auxiliary

     1     and fire police.

     3     Section 4.  This act shall take effect immediately.
