        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           DECEMBER 3, 2001

                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for persons ineligible for
     3     driver's licensing AND FOR NOTICE OF CHANGE OF ADDRESS; AND    <--
     4     PROVIDING FOR PENNSYLVANIA STATE POLICE DUTIES REGARDING
     5     TOWING.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 1503(a) SECTIONS 1503(A) AND 1515 of       <--
     9  Title 75 of the Pennsylvania Consolidated Statutes is ARE         <--
    10  amended to read:
    11  § 1503.  Persons ineligible for licensing; license issuance to
    12             minors; junior driver's license.
    13     (a)  Persons ineligible for licensing.--The department shall
    14  not issue a driver's license to, or renew the driver's license
    15  of, any person:
    16         (1)  Whose operating privilege is suspended or revoked in
    17     this or any other state.
    18         (3)  Who is a user of alcohol or any controlled substance
    19     to a degree rendering the user incapable of safely driving a

     1     motor vehicle. This paragraph does not apply to any person
     2     who is enrolled or otherwise participating in a methadone or
     3     other controlled substance treatment program approved by the
     4     Department of Health provided that the person is certified to
     5     be competent to drive by a physician designated by the
     6     Department of Health.
     7         (4)  Who has been adjudged to be afflicted with or
     8     suffering from any mental disability or disease and who has
     9     not at the time of application been restored to competency by
    10     the methods provided by law.
    11         (5)  Whose name has been submitted under the provisions
    12     of section 1518 (relating to reports on mental or physical
    13     disabilities or disorders).
    14         (6)  Who is required by the department to take an
    15     examination until the person has successfully passed the
    16     examination.
    17         (7)  Who is under 18 years of age except in accordance
    18     with subsections (b) and (c).
    19         (8)  Who has repeatedly violated any of the provisions of
    20     this chapter. The department shall provide an opportunity for
    21     a hearing upon invoking this paragraph.
    22         (9)  Who is not a resident of this Commonwealth. This
    23     paragraph shall not apply to an employee of the Federal or
    24     State Government or a person in the service of the armed
    25     forces of the United States.

    27  § 1515.  NOTICE OF CHANGE OF NAME OR ADDRESS.                     <--
    28     (A)  GENERAL RULE.--WHENEVER ANY PERSON AFTER APPLYING FOR OR
    29  RECEIVING A DRIVER'S LICENSE MOVES FROM THE ADDRESS NAMED IN THE
    30  APPLICATION OR IN THE DRIVER'S LICENSE ISSUED OR WHEN THE NAME

     1  OF A LICENSEE IS CHANGED SUCH PERSON SHALL, WITHIN 15 DAYS
     2  THEREAFTER, NOTIFY THE DEPARTMENT IN WRITING OF THE OLD AND NEW
     3  ADDRESSES OR OF SUCH FORMER AND NEW NAMES AND OF THE NUMBER OF
     4  ANY LICENSE THEN HELD BY THE PERSON.
     5     (B)  NONRESIDENT.--THE DEPARTMENT SHALL NOT CHANGE THE
     6  ADDRESS ON THE DRIVER'S LICENSE OF A PERSON WHO IS NO LONGER A
     7  RESIDENT OF THIS COMMONWEALTH AND SHALL CANCEL THE DRIVER'S
     8  LICENSE AFTER GIVING 30 DAYS' NOTICE, UNLESS THE PERSON IS AN
     9  EMPLOYEE OF THE FEDERAL OR STATE GOVERNMENT OR IS IN THE SERVICE
    10  OF THE ARMED FORCES OF THE UNITED STATES.
    11     SECTION 2.  TITLE 75 IS AMENDED BY ADDING A SECTION TO READ:
    12  § 3709.1.  PENNSYLVANIA STATE POLICE DUTIES REGARDING TOWING.
    13     WHEN A PENNSYLVANIA STATE POLICE OFFICER RESPONDS TO AN
    14  EMERGENCY SITUATION REQUIRING THE REMOVAL OF VEHICLES OR OTHER
    15  DEBRIS FROM THE ACCIDENT SCENE, THE OFFICER MAY CALL ANY TOWING
    16  COMPANY THAT HE OR SHE BELIEVES IS CAPABLE OF COMPLETING THE
    17  NECESSARY WORK IF THE OFFICER DETERMINES AFTER REASONABLE
    18  INVESTIGATION THAT THERE WILL BE AN UNREASONABLE DELAY IN THE
    19  RESPONSE TIME LEADING TO SERIOUS PUBLIC DANGER IF THE ACCIDENT
    20  IS NOT REMOVED IMMEDIATELY.
    21     Section 2 3.  This act shall take effect in 60 days.           <--
