                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, restricting operators from using cellular
     3     telephones; and imposing penalties.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1. Title 75 of the Pennsylvania Consolidated Statutes
     7  is amended by adding a section to read:
     8  § 3315.  Restricting use of cellular telephones.
     9     (a)  General rule.--No driver shall operate a moving vehicle
    10  on a highway of this Commonwealth, which shall include Federal,
    11  State and municipal highways, while using a cellular telephone.
    12     (b)  Penalty.--A person who violates this section commits a
    13  summary offense and shall, upon conviction, be sentenced to pay
    14  a fine of:
    15         (1)  $200 for a first conviction of the offense.
    16         (2)  $500 plus suspension of operating privileges for a
    17     period of one year for a second or subsequent conviction of
    18     the offense.

     1     Section 2.  This act shall take effect in 60 days.
