        REFERRED TO COMMITTEE ON JUDICIARY, SEPTEMBER 18, 2001

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for reporting of suspected
     3     abuse or a prohibited sexual act.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6312 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subsection to read:
     8  § 6312.  Sexual abuse of children.
     9     * * *
    10     (b.1)  Reporting of suspected abuse or prohibited sexual
    11  act.--
    12         (1)  Any commercial film or photographic print processor
    13     who:
    14             (i)  discovers evidence of suspected sexual abuse of
    15         a minor as defined under 23 Pa.C.S. § 6303 (relating to
    16         definitions) or suspected prohibited sexual acts
    17         involving a minor; and

     1             (ii)  fails to report the same to the Pennsylvania
     2         State Police;
     3     commits a summary offense and shall be sentenced to pay a
     4     fine of not less than $50 for a first offense and not less
     5     than $150 for subsequent offenses.
     6         (2)  Any employer who employs commercial film or
     7     photographic print processors and who fails to inform such
     8     employees of their required reporting under this subsection
     9     commits a summary offense and shall be sentenced to pay a
    10     fine of not less than $300.

    12     Section 2.  This act shall take effect in 60 days.
