                                     AN ACT

     1  Amending the act of April 9, 1929 (P.L.177, No.175), entitled
     2     "An act providing for and reorganizing the conduct of the
     3     executive and administrative work of the Commonwealth by the
     4     Executive Department thereof and the administrative
     5     departments, boards, commissions, and officers thereof,
     6     including the boards of trustees of State Normal Schools, or
     7     Teachers Colleges; abolishing, creating, reorganizing or
     8     authorizing the reorganization of certain administrative
     9     departments, boards, and commissions; defining the powers and
    10     duties of the Governor and other executive and administrative
    11     officers, and of the several administrative departments,
    12     boards, commissions, and officers; fixing the salaries of the
    13     Governor, Lieutenant Governor, and certain other executive
    14     and administrative officers; providing for the appointment of
    15     certain administrative officers, and of all deputies and
    16     other assistants and employes in certain departments, boards,
    17     and commissions; and prescribing the manner in which the
    18     number and compensation of the deputies and all other
    19     assistants and employes of certain departments, boards and
    20     commissions shall be determined," further providing for
    21     contributions to Korea/Vietnam Memorial National Education
    22     Center.

    23     The General Assembly of the Commonwealth of Pennsylvania
    24  hereby enacts as follows:
    25     Section 1.  Section 2507(a) and (b) of the act of April 9,
    26  1929 (P.L.177, No.175), known as The Administrative Code of
    27  1929, added July 11, 1996 (P.L.619, No.105), are amended to


     1  read:
     2     Section 2507.  Contribution to Korea/Vietnam Memorial
     3  National Education Center.--(a)  (1)  For tax years 1997, 1998,
     4  1999 [and], 2000, 2001, 2002, 2003 and 2004, the department
     5  shall provide a space on the face of the Pennsylvania individual
     6  income tax return form whereby an individual may voluntarily
     7  designate a contribution of any amount from the individual's tax
     8  refund to KVM.
     9     (2)  The amount designated by an individual on the
    10  Pennsylvania individual income tax return form shall be deducted
    11  from the tax refund to which such individual is entitled and
    12  shall not constitute a charge against the income tax revenues
    13  due the Commonwealth.
    14     (3)  The department shall determine annually the total amount
    15  designated by individual taxpayers under this section and shall
    16  report the amount to the State Treasurer who shall prepare the
    17  appropriate documentation and transfer the designated amount
    18  from the General Fund to KVM.
    19     (4)  The department shall provide adequate information
    20  regarding the center and its purposes in its instructions for
    21  tax years 1997, 1998, 1999 [and], 2000, 2001, 2002, 2003 and
    22  2004 which accompany Pennsylvania individual income tax return
    23  forms to include the address of KVM to which contributions may
    24  be sent by taxpayers who wish to make additional contributions
    25  to the center.
    26     (5)  This subsection shall apply solely to taxable years
    27  1997, 1998, 1999 [and], 2000, 2001, 2002, 2003 and 2004.
    28     (b)  (1)  KVM shall use all contributions collected under
    29  this section to carry out the following purposes and
    30  responsibilities:

     1     (i)  Determine and prioritize the funding objectives deemed
     2  most necessary to facilitate the development of the center.
     3     (ii)  Obtain assistance and advice from the Department of
     4  Military Affairs, veterans' organizations and the public
     5  regarding the development of the center.
     6     (iii)  Establish projects or programs appropriate to the
     7  furtherance of the purposes of this act, and allocate moneys to
     8  such public or private organizations selected to implement those
     9  programs or projects.
    10     (iv)  Establish programs to promote the voluntary
    11  contribution system set forth in this act and other lawful
    12  programs to solicit additional contributions to KVM and allocate
    13  moneys to implement the same.
    14     (v)  Submit a report to the Military and Veterans Affairs
    15  Committee of the Senate and the Veterans Affairs and Emergency
    16  Preparedness Committee of the House of Representatives by
    17  December 31, [2000] 2005, to include a financial analysis and a
    18  synopsis of the use of the funds collected under the voluntary
    19  contribution system.
    20     (2)  KVM may use funds collected under this section to
    21  develop a program for the sale of public stamps, decals or other
    22  items of personal property to the public intended to signify the
    23  interest of the purchaser in contributing to the center.

    25     Section 2.  This act shall take effect in 60 days.
