        AS AMENDED ON THIRD CONSIDERATION, IN SENATE, OCTOBER 23, 2001

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for unlawful carrying of
     3     paintball guns and markers in vehicles.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 2707.1 2707.2.  Paintball guns and paintball markers.           <--
     9     (a)  Unlawful carrying in vehicle.--
    10         (1)  Except as set forth in paragraph (2), an individual
    11     may not carry a paintball gun or a paintball marker in a
    12     vehicle ON A HIGHWAY unless one of the following apply:        <--
    13             (i)  The paintball gun or paintball marker is
    14         disassembled so that the propellant canister is separate
    15         from the rest of the device and the device is empty of
    16         encapsulated gelatin paintballs.


     1             (ii)  The propellant canister of the paintball gun or
     2         paintball marker has been emptied of its gas or air
     3         propellant and the device is empty of encapsulated
     4         gelatin paintballs.
     5         (2)  Paragraph (1) does not apply to a commercial
     6     paintball field, range or course where passengers are being
     7     transported by the commercial field, range or course operator
     8     to and from designated player areas.
     9     (b)  Penalty.--A person who violates this section commits a
    10  summary offense.
    11     (c)  Definitions.--As used in this section, the following
    12  words and phrases shall have the meanings given to them in this
    13  subsection:
    14     "Paintball gun."  A device designed and manufactured to
    15  propel, by gas or air, an encapsulated gelatin paintball.
    16     "Paintball marker."  A device designed and manufactured to
    17  propel, by gas or air, an encapsulated gelatin paintball.
    18     Section 2.  This act shall take effect in 60 days.
