AN ACT
1 Amending Title 66 (Public Utilities) of the Pennsylvania
2 Consolidated Statutes, further providing for market power
3 remediation.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 2209 of Title 66 of the Pennsylvania
7 Consolidated Statutes is amended by adding a subsection to read:
8 § 2209. Market power remediation.

10 (h.1) Enforcement.--Upon referral by the commission under
11 subsection (g)(1) to the Attorney General of findings regarding
12 any anticompetitive or discriminatory conduct, including the
13 initiation or maintenance of litigation against any present or
14 former retail customer on behalf of or in the name of a third
15 party, by any natural gas distribution company, its affiliated
16 natural gas supplier, or both the company and supplier, the
17 Attorney General shall seek immediate judicial relief to enjoin
18 such conduct and to obtain an award of treble damages for any
1 present or former retail customer injured by such
2 anticompetitive or discriminatory conduct.
