                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for residency status at
     6     institutions of the State System of Higher Education.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the Public School Code of 1949, is amended by adding a
    11  section to read:
    12     Section 2010.1-A.  Residency Status and Rate of Tuition.--(a)
    13  The term "resident" or "residency," or any other term or
    14  expression used to designate a Commonwealth resident student,
    15  when used to determine the rate of tuition to be charged to any
    16  student attending the several institutions, shall be construed
    17  to mean, at a minimum, that:
    18     (1)  The student has received a secondary school diploma or
    19  an equivalency diploma within this Commonwealth.


     1     (2)  The student has resided with a parent or guardian who
     2  has maintained a continuous residence within this Commonwealth
     3  for a period of at least twelve (12) months immediately prior to
     4  the student's initial enrollment.
     5     (3)  Except where the student has resided with a parent or
     6  guardian, as provided for in clause (2), the student must offer
     7  proof that the student has maintained a continuous primary
     8  residence within this Commonwealth for other than educational
     9  purposes for a period of at least twelve months immediately
    10  prior to the student's initial enrollment, and the student must
    11  continue to maintain that separate residence.
    12     (b)  In addition to the requirements of subsection (a), the
    13  board may impose other criteria for establishing a resident or
    14  residency, provided that the other criteria are not inconsistent
    15  with subsection (a).
    16     Section 2.  This act shall take effect in 60 days.
