                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing an incentive program to
     6     increase enrollment at area vocational-technical schools; and
     7     making an appropriation.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    11  as the Public School Code of 1949, is amended by adding a
    12  section to read:
    13     Section 2595.1.  Area Vocational-Technical School Enrollment
    14  Incentive Program.--(a)  Any school district that sponsors an
    15  area vocational-technical school is eligible to participate in


     1  the enrollment incentive program.
     2     (b)  Incentives shall be provided annually to school
     3  districts which sponsor area vocational-technical schools and
     4  which meet or exceed their enrollment goals as those enrollment
     5  goals are established in the area vocational-technical schools'
     6  articles of agreement. Payment of enrollment incentive funds to
     7  school districts that meet or exceed their enrollment goals
     8  shall be based on a school district's increase in student
     9  enrollment. For the purposes of this section, enrollment goals
    10  shall be enrollment goals in effect in the year prior to the
    11  year in which the enrollment incentive is paid.
    12     (c)  Any school district may apply to the Department of
    13  Education for enrollment incentive funds under this section by
    14  submitting data showing that the school district has met or
    15  exceeded its enrollment goal. Data showing that the school
    16  district has met or exceeded its enrollment goal must compare
    17  the school district's enrollment in an area vocational-technical
    18  school in the year prior to the year for which enrollment
    19  incentives are paid to the school district's enrollment in an
    20  area vocational-technical school in the year for which
    21  enrollment incentives are paid.
    22     (d)  For purposes of this section, a school district shall be
    23  eligible for enrollment incentive funds under the following
    24  circumstances:
    25     (1)  Where a school district's enrollment data shows that the
    26  school district has met its enrollment goal, the increase in
    27  student enrollment shall be equal to the difference between the
    28  school district's enrollment goal and the school district's
    29  actual enrollment in an area vocational-technical school in the
    30  year prior to the year for which the enrollment incentive is

     1  paid.
     2     (2)  Where a school district's enrollment data shows that the
     3  school district has exceeded its enrollment goal, the increase
     4  in student enrollment shall be equal to the difference between
     5  the school district's actual enrollment in the area vocational-
     6  technical school and the school district's enrollment in the
     7  area vocational-technical school in the year prior to the year
     8  for which the enrollment incentive is paid.
     9     (e)  The Secretary of Education shall award a school district
    10  that applies for enrollment incentive funds under subsection (c)
    11  and meets or exceeds its enrollment goal an amount determined by
    12  multiplying the increase in student enrollment as determined by
    13  subsection (d) by a fixed amount per student established
    14  annually when the appropriation for the area vocational-
    15  technical school enrollment incentive program is established.
    16  The fixed amount per student shall not exceed two thousand
    17  dollars ($2,000).
    18     (f)  Enrollment incentive funds shall be paid only to school
    19  districts that qualify pursuant to subsection (b).
    20     Section 2.  The sum of $10,000,000, or as much thereof as may
    21  be necessary, is hereby appropriated to the Department of
    22  Education for the fiscal year July 1, 2001, to June 30, 2002,
    23  for purposes of enrollment incentive payments for area
    24  vocational-technical schools.
    25     Section 3.  This act shall take effect July 1, 2001.
