                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for chemical testing to determine
     3     amount of alcohol or controlled substance and for driving
     4     under the influence of alcohol or controlled substances.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Sections 1547(d) and 3731(a) and (a.1) of Title
     8  75 of the Pennsylvania Consolidated Statutes are amended to
     9  read:
    10  § 1547.  Chemical testing to determine amount of alcohol or
    11             controlled substance.

    13     (d)  Presumptions from amount of alcohol.--If chemical
    14  testing of a person's breath, blood or urine shows:
    15         (1)  That the amount of alcohol by weight in the blood of
    16  an adult is 0.05% or less, it shall be presumed that the adult
    17  was not under the influence of alcohol and the adult shall not


     1  be charged with any violation under section 3731(a)(1), (4) or
     2  (5) (relating to driving under influence of alcohol or
     3  controlled substance), or, if the adult was so charged prior to
     4  the test, the charge shall be void ab initio. This fact shall
     5  not give rise to any presumption concerning a violation of
     6  section 3731(a)(2) or (3) or (i).
     7         (2)  That the amount of alcohol by weight in the blood of
     8     an adult is in excess of 0.05% but less than [0.10%] 0.08%,
     9     this fact shall not give rise to any presumption that the
    10     adult was or was not under the influence of alcohol, but this
    11     fact may be considered with other competent evidence in
    12     determining whether the adult was or was not under the
    13     influence of alcohol. This provision shall not negate the
    14     provisions of section 3731(i).
    15         (3)  That the amount of alcohol by weight in the blood
    16     of:
    17             (i)  an adult is [0.10%] 0.08% or more; or
    18             (ii)  a minor is 0.02% or more.
    19     This fact may be introduced into evidence if the person is
    20     charged with violating section 3731.

    22  § 3731.  Driving under influence of alcohol or controlled
    23             substance.
    24     (a)  Offense defined.--A person shall not drive, operate or
    25  be in actual physical control of the movement of a vehicle in
    26  any of the following circumstances:
    27         (1)  While under the influence of alcohol to a degree
    28     which renders the person incapable of safe driving.
    29         (2)  While under the influence of any controlled
    30     substance, as defined in the act of April 14, 1972 (P.L.233,

     1     No.64), known as The Controlled Substance, Drug, Device and
     2     Cosmetic Act, to a degree which renders the person incapable
     3     of safe driving.
     4         (3)  While under the combined influence of alcohol and
     5     any controlled substance to a degree which renders the person
     6     incapable of safe driving.
     7         (4)  While the amount of alcohol by weight in the blood
     8     of:
     9             (i)  an adult is [0.10%] 0.08% or greater; or
    10             (ii)  a minor is 0.02% or greater.
    11         (5)  If all of the following apply:
    12             (i)  At the time of a chemical test of a sample of
    13         the person's breath, blood or urine, the amount of
    14         alcohol by weight in the blood of:
    15                 (A)  an adult is [0.10%] 0.08% or greater; or
    16                 (B)  a minor is 0.02% or greater.
    17             (ii)  Either:
    18                 (A)  the sample is obtained within three hours
    19             after the person drove, operated or was in actual
    20             physical control of the vehicle; or
    21                 (B)  the circumstances of the incident prevent
    22             collecting the sample within three hours, obtained
    23             within a reasonable additional time after the person
    24             drove, operated or was in actual physical control of
    25             the vehicle.
    26     (a.1)  Defense.--It shall be a defense to a prosecution under
    27  subsection (a)(5) if the person proves by a preponderance of
    28  evidence all of the following:
    29         (1)  The person consumed alcohol after the last instance
    30     in which he drove, operated or was in actual physical control

     1     of the vehicle.
     2         (2)  The amount of alcohol by weight in:
     3             (i)  an adult's blood would not have exceeded [0.10%]
     4         0.08% at the time of the test but for such consumption;
     5         or
     6             (ii)  a minor's blood would not have exceeded 0.02%
     7         at the time of the test but for such consumption.

     9     Section 2.  This act shall take effect in 60 days.
