                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for pedalcycle helmets for
     3     certain persons.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3510(a), (b), (b.1) and (e) of Title 75
     7  of the Pennsylvania Consolidated Statutes are amended to read:
     8  § 3510.  Pedalcycle helmets for certain persons.
     9     (a)  General rule.--A person under 12 years of age shall not
    10  operate a pedalcycle [or], ride as a passenger on a pedalcycle,
    11  operate a scooter or ride as a passenger on a scooter unless the
    12  person is wearing a pedalcycle helmet meeting the standards of
    13  the American National Standards Institute, the American Society
    14  for Testing and Materials, the Snell Memorial Foundation's
    15  Standards for Protective Headgear for Use in Bicycling or any
    16  other nationally recognized standard for pedalcycle helmet
    17  approval. This subsection shall also apply to a person who

     1  rides:
     2         (1)  upon a pedalcycle while in a restraining seat
     3     attached to a pedalcycle; or
     4         (2)  in a trailer towed by a pedalcycle.
     5     (b)  Helmet to be labeled.--Any helmet sold or offered for
     6  sale for use by operators and passengers of pedalcycles or
     7  scooters shall be labeled in accordance with the standard
     8  described in subsection (a), which shall constitute the
     9  manufacturer's certification that the helmet conforms to the
    10  applicable safety standards.
    11     (b.1)  Sale of helmet.--No person shall sell or offer for
    12  sale for use by an operator or passenger of a pedalcycle or
    13  scooter a helmet which is not of a type meeting the requirements
    14  established by this section.

    16     (e)  Definitions.--As used in this section, the [term
    17  "wearing a pedalcycle helmet" means having] following words and
    18  phrases shall have the meanings given to them in this
    19  subsection:
    20     "Scooter."  A vehicle that has two wheels with a low
    21  footboard between them, is steered by a handlebar and is
    22  propelled by pushing one foot against the ground while resting
    23  the other on the footboard.
    24     "Wearing a pedalcycle helmet."  Having a pedalcycle helmet of
    25  good fit fastened securely upon the head with the helmet straps.
    26     Section 2.  This act shall take effect in 60 days.
