AN ACT 1 Amending Title 34 (Game) of the Pennsylvania Consolidated 2 Statutes, restricting the use of certain revenues; and 3 establishing a restricted account within the Game Fund. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 521(b) of Title 34 of the Pennsylvania 7 Consolidated Statutes is amended and the section is amended by 8 adding a subsection to read: 9 § 521. Establishment and use of Game Fund. 10 * * * 11 (b) Specific allocation of certain revenues.-- 12 (1) A minimum of $1.25 from each resident license for 13 which the full fee has been paid and a minimum of $2 from 14 each antlerless deer license issued for which the full fee 15 has been paid shall be used solely for habitat improvement 16 and restoration conducive to increasing natural propagation
1 of game or wildlife on all lands under the control or 2 operation of the commission, including lands enrolled in the 3 commission's public access programs and other public lands 4 open to hunting under agreement with the commission. The 5 moneys collected under this paragraph shall be deposited into 6 two separate accounts and shall be used exclusively for the 7 natural propagation of game and wildlife by: 8 (i) Improving and maintaining any natural wildlife 9 habitat by the production, distribution and planting of 10 trees, shrubs, vines and forage crops. 11 (ii) Forest management practices related to the 12 creation and development of food and cover. 13 (iii) Development and management of food and cover 14 openings. 15 (iv) Purchase, construction and enhancement of 16 wetlands and riparian areas. 17 (v) Construction and maintenance of nesting 18 structures. 19 (vi) The prorated cost for the purchase, maintenance 20 and operation of equipment, tools and materials necessary 21 to meet the habitat improvement objectives of this 22 section. No moneys in these accounts shall be used for 23 capital purchases under this subparagraph. 24 The commission shall submit an annual report on all 25 expenditures from this account in the manner prescribed under 26 section 522 (relating to appropriation and audit of moneys). 27 (2) Any moneys collected by or for the commission from 28 the sale of the migratory bird hunting license shall be used 29 solely for the purpose of migratory game bird management, 30 habitat acquisition and improvement and related program 20010H0192B0172 - 2 -
1 administrative costs.
2 (3) A minimum of $3 from each resident and nonresident
3 license for which the full fee has been paid shall be used
4 solely for habitat improvement and restoration conducive to
5 increasing natural propagation of game on all lands under the
6 control or operation of the commission, including lands
7 enrolled in the commission's public access programs and other
8 public lands open to hunting under agreement with the
9 commission. The moneys collected under this paragraph shall
10 be used exclusively for the natural propagation of game by:
11 (i) Improving and maintaining any natural wildlife
12 habitat by the production, distribution and planting of
13 trees, shrubs, vines and forage crops.
14 (ii) Forest management practices related to the
15 creation and development of food and cover.
16 (iii) Development and management of food and cover
17 openings.
18 (iv) Construction and enhancement of wetlands and
19 riparian areas.
20 (v) Construction and maintenance of nesting
21 structures.
22 (vi) The prorated cost for the maintenance and
23 operation of equipment, tools and materials necessary to
24 meet the habitat improvement objectives of this section.
25 No moneys in these accounts shall be used for capital
26 purchases under this subparagraph.
27 The commission shall submit an annual report on all
28 expenditures from this account in the manner prescribed under
29 section 522.
30 (4) All moneys from the sale of oil, gas, minerals or

1 right-of-way easements on any lands under the control or 2 operation of the commission shall be used solely for game and 3 wildlife propagation and habitat improvement. 4 (c) Restricted account.--All moneys specifically allocated 5 under subsection (b) shall be deposited into a separate account 6 within the Game Fund which shall be known as the Propagation and 7 Habitat Improvement Account. The moneys in this account shall be 8 used exclusively for the purposes of game and wildlife 9 propagation and habitat improvement and as more specifically set 10 forth in subsection (b). No portion of the moneys in this 11 account may be used to pay or reimburse any costs associated 12 directly or indirectly with the commercial sale of timber or 13 wood used for fuel. 14 Section 2.
