SENATE BILL

                               A JOINT RESOLUTION

     1  Proposing an amendment to the Constitution of the Commonwealth
     2     of Pennsylvania, further providing for retirement of
     3     justices, judges and justices of the peace.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby resolves as follows:
     6     Section 1.  The following amendment to the Constitution of
     7  Pennsylvania is proposed in accordance with Article XI:
     8     That section 16(b) of Article V be amended to read:
     9  § 16.  Compensation and retirement of justices, judges and
    10             justices of the peace.

    12     (b)  Justices, judges and justices of the peace shall be
    13  retired [upon attaining] on the last day of the calendar year in
    14  which they attain the age of 70 years. Former and retired
    15  justices, judges and justices of the peace shall receive such
    16  compensation as shall be provided by law. Except as provided by
    17  law, no salary, retirement benefit or other compensation,


     1  present or deferred, shall be paid to any justice, judge or
     2  justice of the peace who, under section 18 or under Article VI,
     3  is suspended, removed or barred from holding judicial office for
     4  conviction of a felony or misconduct in office or conduct which
     5  prejudices the proper administration of justice or brings the
     6  judicial office into disrepute.

     8     Section 2.  Upon the second passage by the General Assembly
     9  of this proposed constitutional amendment, the Secretary of the
    10  Commonwealth shall proceed immediately to comply with the
    11  advertising requirements of section 1 of Article XI of the
    12  Constitution of Pennsylvania and shall transmit the required
    13  advertisements to two newspapers in every county in which such
    14  newspapers are published in sufficient time after passage of
    15  this proposed constitutional amendment. The Secretary of the
    16  Commonwealth shall submit this proposed constitutional amendment
    17  to the qualified electors of this Commonwealth at the first
    18  primary, general or municipal election occurring at least three
    19  months after the proposed constitutional amendment is passed by
    20  the General Assembly which meets the requirements of and is in
    21  conformance with section 1 of Article XI of the Constitution of
    22  Pennsylvania.
