AN ACT 1 Amending Title 42 (Judiciary and Judicial Procedure) of the 2 Pennsylvania Consolidated Statutes, further providing for 3 registration of sexual offenders. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Sections 9795.1 and 9795.2(a)(3) of Title 42 of 7 the Pennsylvania Consolidated Statutes, added May 10, 2000 8 (P.L.74, No.18), are amended to read: 9 § 9795.1. Registration. 10 [(a) Ten-year registration.--The following individuals shall 11 be required to register with the Pennsylvania State Police for a 12 period of ten years: 13 (1) Individuals convicted of any of the following 14 offenses: 15 18 Pa.C.S. § 2901 (relating to kidnapping) where the 16 victim is a minor. 17 18 Pa.C.S. § 3126 (relating to indecent assault) 18 where the offense is a misdemeanor of the first degree.
1 18 Pa.C.S. § 4302 (relating to incest) where the 2 victim is 12 years of age or older but under 18 years of 3 age. 4 18 Pa.C.S. § 5902(b) (relating to prostitution and 5 related offenses) where the actor promotes the 6 prostitution of a minor. 7 18 Pa.C.S. § 5903(a)(3), (4), (5) or (6) (relating to 8 obscene and other sexual materials and performances) 9 where the victim is a minor. 10 18 Pa.C.S. § 6312 (relating to sexual abuse of 11 children). 12 18 Pa.C.S. § 6318 (relating to unlawful contact or 13 communication with minor). 14 (2) Individuals convicted of an attempt to commit any of 15 the offenses under paragraph (1) or subsection (b)(2). 16 (b) Lifetime registration.--The following individuals] An 17 individual who has been convicted of any of the following 18 offenses shall be subject to lifetime registration: 19 [(1) An individual with two or more convictions of any 20 of the offenses set forth in subsection (a). 21 (2) Individuals convicted of any of the following 22 offenses:] 23 18 Pa.C.S. § 2901 (relating to kidnapping) if the 24 victim is a minor. 25 18 Pa.C.S. § 3121 (relating to rape). 26 18 Pa.C.S. § 3123 (relating to involuntary deviate 27 sexual intercourse). 28 18 Pa.C.S. § 3124.1 (relating to sexual assault). 29 18 Pa.C.S. § 3125 (relating to aggravated indecent 30 assault). 20000H2779B3988 - 2 -
1 18 Pa.C.S. § 3126 (relating to indecent assault) if 2 the offense is a misdemeanor of the first degree. 3 18 Pa.C.S. § 4302 (relating to incest) when the 4 victim is under [12] 18 years of age. 5 [(3) Sexually violent predators.] 6 18 Pa.C.S. § 5902(b) (relating to prostitution and 7 related offenses) if the actor promoted the prostitution 8 of a minor. 9 18 Pa.C.S. § 5903(a)(3), (4), (5) or (6) (relating to 10 obscene and other sexual materials and performances) if 11 the victim is a minor. 12 18 Pa.C.S. § 6312 (relating to sexual abuse of 13 children). 14 18 Pa.C.S. § 6318 (relating to unlawful contact or 15 communication with minor). 16 § 9795.2. Registration procedures and applicability. 17 (a) Registration.-- 18 * * * 19 (3) [The ten-year registration period required in] If an 20 offender subject to section 9795.1[(a)] (relating to 21 registration) [shall be tolled when an offender] is 22 recommitted for a parole violation or sentenced to an 23 additional term of imprisonment[. In such cases], the 24 Department of Corrections or county correctional facility 25 shall notify the Pennsylvania State Police of the admission 26 of the offender. 27 * * * 28 Section 2.
