                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for prohibitions in specific
     3     areas.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3353(c) and (e) of Title 75 of the
     7  Pennsylvania Consolidated Statutes are amended to read:
     8  § 3353.  Prohibitions in specified places.
     9     * * *
    10     (c)  Property owner may remove vehicle.--The owner or other
    11  person in charge or possession of any property on which a
    12  vehicle is parked or left unattended in violation of the
    13  provisions of subsection (b) may remove or have removed the
    14  vehicle at the reasonable expense of the owner of the vehicle if
    15  the maximum towing fee is clearly posted to notify the public.
    16  Such person who removes a vehicle left parked or unattended in
    17  violation of the provisions of subsection (b) shall have a lien
    18  against the owner of the vehicle, in the amount of the

     1  reasonable value of the costs of removing the vehicle. Any city,
     2  borough, incorporated town or township may, by ordinance,
     3  provide for rates to be charged for removal of vehicles and for
     4  municipal regulation of authorized towing services. A towing
     5  company shall not tow or be permitted to tow a vehicle outside
     6  the county in which the violation of subsection (b) occurred.

     8     (e)  Penalty.--
     9         (1)  Any person other than a towing service violating any
    10     provision of this section is guilty of a summary offense and
    11     shall, upon conviction, be sentenced to pay a fine of not
    12     more than $15.
    13         (2)  A towing service violating any provision of this
    14     section is guilty of misdemeanor of the third degree.
    15     Section 2.  This act shall take effect in 60 days.
