                                     AN ACT

     1  Providing for lead-level testing of day-care and preschool
     2     facilities; and making an appropriation.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Hazardous
     7  Lead-Level Testing Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Department."  The Department of Health of the Commonwealth.
    13     "Risk area."  Any of the following:
    14         (1)  A day-care center or facility supervised or licensed
    15     by the Department of Public Welfare.

     1         (2)  A licensed nursery school.
     2         (3)  A private academic school which provides preschool
     3     education.
     4         (4)  A preschool owned or operated by or under the
     5     authority of a bona fide religious institution.
     6         (5)  A preschool accredited by the National Association
     7     for the Education of Young Children (NAEYC).
     8  Section 3.  Testing and reporting.
     9     (a)  Testing.--The department shall conduct testing to
    10  determine the presence and levels of hazardous lead in risk
    11  areas. The department shall schedule testing so that all risk
    12  areas in this Commonwealth are tested within five years of the
    13  effective date of this act.
    14     (b)  Abatement resources.--The department shall provide
    15  resource and referral information relating to lead abatement,
    16  including available Federal and State government programs, to
    17  each entity which has control over any risk area that is found
    18  to contain hazardous lead.
    19     (c)  Report.--The department shall publish in the
    20  Pennsylvania Bulletin an annual report of the testing under
    21  subsection (a).
    22  Section 4.  Appropriation.
    23     The sum of $2,500,000 is hereby appropriated to the
    24  Department of Health for the fiscal year July 1, 1999, to June
    25  30, 2000, to carry out the provisions of this act. This
    26  appropriation shall be a continuing appropriation and shall
    27  lapse on June 30, 2005.
    28  Section 5.  Effective date.
    29     This act shall take effect in 60 days.
