AN ACT 1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An 2 act to consolidate, editorially revise, and codify the public 3 welfare laws of the Commonwealth," providing for 4 transportation ratios for child day-care centers. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. The act of June 13, 1967 (P.L.31, No.21), known 8 as the Public Welfare Code, is amended by adding a section to 9 read: 10 Section 923. Transportation Ratios.--(a) The department 11 shall promulgate rules and regulations for the transportation of 12 children attending a child day care center, which rules and 13 regulations shall provide that: 14 (1) Whenever children are transported by the center, the 15 driver of the vehicle transporting the children shall fulfill 16 the staff requirement of any staff-child ratio established by 17 the department.
1 (2) Whenever more than two non-school age children are 2 transported by the center, there shall be an additional staff 3 person in the vehicle transporting the children. 4 (b) For purposes of this section, "child day care center" 5 includes any facility that provides child day care and that is 6 subject to supervision or licensure, LICENSURE OR CERTIFICATION <-- 7 by the department under this article or Article X. THE TERM <-- 8 "SCHOOL-AGE CHILD" MEANS A CHILD FROM THE EARLIEST ADMISSION AGE 9 TO A PUBLIC OR PRIVATE SCHOOL'S KINDERGARTEN PROGRAM OR, WHEN NO 10 KINDERGARTEN PROGRAM IS PROVIDED, THE SCHOOL'S ADMISSION AGE FOR 11 BEGINNERS, UNTIL THE STUDENT ATTAINS FIFTEEN YEARS OF AGE. 12 Section 2. All regulations or parts of regulations are 13 abrogated insofar as they are inconsistent with this act. 14 Section 3. This act shall take effect in 60 days. K5L67DMS/19990H2055B2883 - 2 -
