                                     AN ACT

     1  Relating to notification of condemnation proceedings by a public
     2     utility.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Notification of condemnation.
     6     A public utility or pipeline company possessing the authority
     7  to condemn real property must provide written notice of its
     8  intent to condemn any real property to all municipalities in
     9  which the real property is located at least 120 days prior to
    10  initiating any action under the act of June 22, 1964 (Sp.Sess.,
    11  P.L.84, No.6) known as the Eminent Domain Code.
    12  Section 2.  Exception.
    13     A public utility or pipeline company is not required to
    14  provide the notice required under section 1 where it is acting
    15  in response to an emergency.
    16  Section 3.  Effective date.
    17     This act shall take effect in 60 days.
