AN ACT
1 Amending Title 62 (Procurement) of the Pennsylvania Consolidated
2 Statutes, providing for bids for bridge construction.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Title 62 of the Pennsylvania Consolidated
6 Statutes is amended by adding a section to read:
7 § 906. Bids for bridge construction.
8 During the environmental phase of a bridge construction
9 project under the act of June 1, 1945 (P.L.1242, No.428), known
10 as the State Highway Law, the Department of Transportation:
11 (1) May not make a specific commitment as to structural
12 materials.
13 (2) Shall allow a bidder to submit a contractor-
14 alternate-design bid for the project. The contractor-
15 alternate-design bid shall be subject to and must meet the
16 same environmental limits as the department-developed design.
17 Modification of an environmental permit necessitated by
1 acceptance of the contractor-alternate-design bid shall be at
2 the expense of the bidder.
3 Section 2. This act shall take effect in 120 days.
