                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for improper exhibition of
     3     cigarette vending machines.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 6306.2.  Cigarette vending machine exhibition.
     9     (a)  Offense defined.--A retailer or vending machine operator
    10  commits a summary offense if the retailer or vending machine
    11  operator displays or places, or permits the display or placement
    12  of, a cigarette vending machine in a business, commercial
    13  establishment or public thoroughfare, in such a manner that a
    14  minor under 18 years of age has access to the machine.
    15     (b)  Penalty.--A retailer or vending machine operator who
    16  violates this section shall, upon conviction, be sentenced to
    17  pay a fine of not less than $25 for a first offense and not less
    18  than $100 for a subsequent offense.

     1     (c)  Definitions.--As used in this section, the following
     2  words and phrases shall have the meanings given to them in this
     3  subsection:
     4     "Cigarette vending machine."  As defined in section 202-A of
     5  the act of April 9, 1929 (P.L.343, No.176), known as The Fiscal
     6  Code.
     7     "Retailer."  As defined in section 202-A of the act of April
     8  9, 1929 (P.L.343, No.176), known as The Fiscal Code.
     9     "Vending machine operator."  As defined in section 202-A of
    10  the act of April 9, 1929 (P.L.343, No.176), known as The Fiscal
    11  Code.
    12     Section 2.  This act shall take effect in 60 days.
