                                     AN ACT

     1  Amending the act of May 1, 1984 (P.L.206, No.43), entitled "An
     2     act providing for safe drinking water; imposing powers and
     3     duties on the Department of Environmental Resources in
     4     relation thereto; and appropriating certain funds," providing
     5     for certain mandatory minimum standards.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 4(a) of the act of May 1, 1984 (P.L.206,
     9  No.43), known as the Pennsylvania Safe Drinking Water Act, is
    10  amended and the section is amended by adding a subsection to
    11  read:
    12  Section 4.  Powers and duties of Environmental Quality Board.
    13     (a)  Board to establish standards, rules and regulations.--
    14  The Environmental Quality Board shall have the power and its
    15  duty shall be to adopt such rules and regulations of the
    16  department, governing the provision of drinking water to the
    17  public, as it deems necessary for the implementation of the
    18  provisions of this act. [The] Except as provided in subsection


     1  (d), the board shall adopt maximum contaminant levels and
     2  treatment technique requirements no less stringent than those
     3  promulgated under the Federal act for all contaminants regulated
     4  under the national primary and secondary drinking water
     5  regulations. The board may adopt maximum contaminant levels or
     6  treatment technique requirements for any contaminant that a
     7  maximum contaminant level or treatment technique requirement has
     8  not been promulgated under the national primary and secondary
     9  drinking water regulations.

    11     (d)  Mandatory minimum standards.--Notwithstanding the
    12  provisions of subsection (a) or any other provision of law to
    13  the contrary, the board shall require that the maximum
    14  acceptable level of sulfates in drinking water shall not exceed
    15  200 milligrams per liter, that the maximum level of total
    16  dissolved solids in drinking water shall not exceed 375
    17  milligrams per liter and that the pH of drinking water shall be
    18  between 6.5 and 8.0. Testing to enforce the standards
    19  established by this subsection shall occur at least once per
    20  year.
    21     Section 2.  This act shall take effect in one year.
