                                     AN ACT

     1  Amending Titles 24 (Education) and 71 (State Government) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     eligibility for limited early retirement.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 8313 of Title 24 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 8313.  Eligibility for limited early retirement.
     9     Notwithstanding any provisions of this title to the contrary,
    10  the following early retirement provisions shall be applicable to
    11  eligible members:
    12         (1)  Any member who, during the period of time from the
    13     effective date of this section through July 10, 1998:

     1             (i)  has credit for at least 30 eligibility points;
     2             (ii)  terminates school service; and
     3             (iii)  files an application for an annuity with an
     4         effective date of retirement not later than July 11,
     5         1998,
     6     shall be entitled to receive a maximum single life annuity
     7     calculated pursuant to section 8342 (relating to maximum
     8     single life annuity) without any reduction by virtue of an
     9     effective date of retirement which is under the
    10     superannuation age.
    11         (2)  Any member who, during the period of time from April
    12     1, 1999, through June 30, 1999:
    13             (i)  has credit for at least 30 eligibility points;
    14             (ii)  terminates school service; and
    15             (iii)  files an application for an annuity with an
    16         effective date of retirement not later than July 1, 1999,
    17     shall be entitled to receive a maximum single life annuity
    18     calculated pursuant to section 8342 without any reduction by
    19     virtue of an effective date of retirement which is under the
    20     superannuation age.
    21         (3)  Any member who, during the period of time from April
    22     1, 2000, through June 30, 2000:
    23             (i)  has credit for at least 30 eligibility points;
    24             (ii)  terminates school service; and
    25             (iii)  files an application for an annuity with an
    26         effective date of retirement not later than July 1, 2000,
    27     shall be entitled to receive a maximum single life annuity
    28     calculated pursuant to section 8342 without any reduction by
    29     virtue of an effective date of retirement which is under the
    30     superannuation age.

     1         (4)  Any member who, during the period of time from April
     2     1, 2001, through June 30, 2001:
     3             (i)  has credit for at least 30 eligibility points;
     4             (ii)  terminates school service; and
     5             (iii)  files an application for an annuity with an
     6         effective date of retirement not later than July 1, 2001,
     7     shall be entitled to receive a maximum single life annuity
     8     calculated pursuant to section 8342 without any reduction by
     9     virtue of an effective date of retirement which is under the
    10     superannuation age.
    11     Section 2.  Section 5308.2 of Title 71 is amended to read:
    12  § 5308.2.  Eligibility for limited early retirement.
    13     Notwithstanding any provisions of this title to the contrary,
    14  any eligible member who, during the period of time from July 1,
    15  1998, through June 30, [1999] 2001:
    16         (1)  has credit for at least 30 eligibility points;
    17         (2)  terminates State service; and
    18         (3)  files an application for an annuity with an
    19     effective date of retirement not later than July 1, [1999,]
    20     2001,
    21  shall be entitled to receive a maximum single life annuity
    22  calculated pursuant to section 5702 (relating to maximum single
    23  life annuity) without any reduction by virtue of an effective
    24  date of retirement which is under the superannuation age.
    25     Section 3.  This act shall take effect immediately.
