AN ACT
1 Authorizing and directing the Department of General Services,
2 with the approval of the Governor and the Secretary of
3 Conservation and Natural Resources, to convey to Jackson
4 Township a road right-of-way situate in Jackson Township,
5 Dauphin County, Pennsylvania; and authorizing the Department
6 of General Services to convey a tract of land located in
7 Somerset Township, Somerset County.
8 The General Assembly of the Commonwealth of Pennsylvania
9 hereby enacts as follows:
10 Section 1. (a) Authorization.--The Department of General
11 Services, with the approval of the Governor and the Secretary of
12 Conservation and Natural Resources, is hereby authorized and
13 directed on behalf of the Commonwealth of Pennsylvania to grant
14 and convey to Jackson Township the following road right-of-way
15 (known as White Oak Road) situate in Jackson Township, Dauphin
16 County, Pennsylvania, having a width of 33 feet, measured 16 1/2
17 feet on either side of the center line, bounded and described as
18 follows:
19 Beginning at a point at the intersection of the White Oak
20 Road with the Detrich Road (formerly known as Mucklerats Road),
1 T-585; thence following the centerline of the existing White Oak
2 Road the following courses; with a chord length of 260.57 feet
3 at a bearing of north 34 degrees 4 minutes 13 seconds east by an
4 arc distance of 262.43 feet and a radius of 635 feet; by a
5 tangent distance of 40.06 feet with a bearing of north 42
6 degrees 10 minutes 48 seconds east; with a chord length of
7 235.58 feet at a bearing of north 51 degrees 19 minutes 49
8 seconds east by an arc distance of 244.49 feet and a radius of
9 260 feet; with a chord length of 274.25 feet at a bearing of
10 north 54 degrees 35 minutes 3 seconds east by an arc distance of
11 276.54 feet and a radius of 620 feet; with a chord length of
12 287.56 feet at a bearing of north 72 degrees 38 minutes 43
13 seconds east by an arc distance of 291.95 feet and a radius of
14 485 feet; with a chord length of 436.87 feet at a bearing of
15 south 47 degrees 46 minutes 21 seconds east by an arc distance

4 of the Old Mucklerats Township Road.
5 Being a right-of-way 33 feet in width, having a total linear
6 distance of 9862.26 feet and containing 7.47 acres of land, more
7 or less.
8 (b) Improvement.--Prior to the conveyance, the Department of
9 Conservation and Natural Resources shall construct or improve a
10 level, hard surface road having a width of 18 feet, together
11 with any necessary concrete culverts and essential pipes for
12 appropriate drainage, that extends the total linear distance of
13 the right-of-way.
14 (c) Easements.--The conveyance shall be made under and
15 subject to all easements, servitudes and rights of others,
16 including, but not confined to, rights of telephone, telegraph,
17 water, electric, sewer, gas or pipeline companies, as well as
18 under and subject to any interest, estates or tenancies vested
19 in third persons, whether or not appearing of record, for any
20 portion of the land.
21 (d) Reverter.--The deed of conveyance shall contain a clause
22 that the property conveyed shall be used for public road
23 purposes by Jackson Township and if at any time Jackson Township
24 or its successor conveys the property or permits the property to
25 be used for any purpose other than those specified in this
26 section, the title to the property shall immediately revert to
27 and revest in the Commonwealth of Pennsylvania.
28 (e) Forest lands.--The deed of conveyance shall contain a
29 clause excepting and reserving to the Department of Conservation
30 and Natural Resources the privilege of using and authorizing the

1 use by others of said road for any and all purposes in
2 connection with the administration, operation or utilization of
3 State forest lands.
4 (f) Execution.--The deed of conveyance shall be approved as
5 provided by law and shall be executed by the Secretary of
6 General Services in the name of the Commonwealth of
7 Pennsylvania.
8 (g) Costs.--Except as otherwise provided in subsection (b),
9 costs and fees incidental to the conveyance shall be borne by
10 the grantee.
11 Section 2. (a) Authorization.--The Department of General
12 Services, with the approval of the Governor, is hereby
13 authorized and directed, on behalf of the Commonwealth of
14 Pennsylvania, to grant and convey, Somerset Christian
15 Fellowship, the described tract of land in subsection (b) for
16 fair market value as determined by an independent appraisal.
17 (b) Description.--Beginning at an existing iron pin/cap and
18 on the jurisdictional division line between lands of the
19 Somerset Christian Fellowship and lands of the Commonwealth of
20 Pennsylvania. Thence along lands of the Commonwealth of
21 Pennsylvania and the Somerset Christian Fellowship the following
22 courses and distances;
23 (1) South 65 degrees 43 minutes 09 seconds East, 403.22
24 feet to set iron pin/cap;
25 (2) North 39 degrees 36 minutes 00 seconds East, 238.77
26 feet to set iron pin/cap;
27 (3) South 22 degrees 49 minutes 30 seconds West, 32.30
28 feet to set iron pin/cap;
29 (4) South 38 degrees 46 minutes 00 seconds West, 139.80
30 feet to set iron pin/cap;

10 (c) Easement.--The conveyance shall be made under and
11 subject to all easements, servitudes and rights of others,
12 including but not confined to, streets, roadways and rights of
13 telephone, telegraph, water, electric, sewer, gas or pipeline
14 companies, as well as under and subject to any interest, estates
15 or tenancies vested in third persons, whether or not appearing
16 of record, for any portion of the land or improvements erected
17 thereon.
18 (d) Deed.--The deed of conveyance shall be approved as
19 provided by law and shall be executed by the Secretary of
20 General Services in the name of the Commonwealth of
21 Pennsylvania.
22 (e) Costs.--The costs and fees incidental to this conveyance
23 shall be borne by the grantee.
24 Section 3. This act shall take effect immediately.
