        AS REPORTED FROM COMMITTEE ON JUDICIARY, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JANUARY 26, 1999

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, making the appearance in public while
     3     under the influence of a controlled substance an offense; and  <--
     4     defining an offense relating to the possession of certain
     5     substances.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 5505 of Title 18 of the Pennsylvania
     9  Consolidated Statutes is amended to read:
    10  § 5505.  [Public drunkenness.] Under influence of alcohol or
    11             controlled substance in public place.
    12     A person is guilty of a summary offense if he appears in any
    13  public place manifestly under the influence of alcohol or a
    14  controlled substance, as defined in the act of April 14, 1972
    15  (P.L.233, No.64), known as The Controlled Substance, Drug,
    16  Device and Cosmetic Act, to the degree that he may endanger
    17  himself or other persons or property, or annoy persons in his


     1  vicinity.
     2     Section 2.  Title 18 is amended by adding a section to read:   <--
     3  § 5518.  Possession of certain substances prohibited.
     4     (a)  Offense defined.--The manufacture, possession, use or
     5  delivery of flunitrazepam or gamma hydroxybutyric acid is
     6  prohibited.
     7     (b)  Penalty.--A violation of this section constitutes a
     8  misdemeanor of the third degree.
     9     Section 3 2.  This act shall take effect in 60 days.           <--
