                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further prohibiting use of dyed diesel fuel on
     3     highways.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 9019(f) of Title 75 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 9019.  Diesel fuel importers and transporters; prohibiting use
     9             of dyed diesel fuel on highways; violations and
    10             penalties.

    12     (f)  Civil penalty.--In addition to any penalty provided in
    13  subsection (d), a person who violates subsection (c)(1) or (2)
    14  shall be assessed a penalty [of] not to exceed $1,000 or $10 per
    15  gallon of dyed diesel fuel involved in the sale, delivery or
    16  consumption, whichever amount is more. This amount shall be
    17  multiplied by the number of prior penalties imposed on the
    18  violator under this subsection. The resulting product shall be

     1  the penalty to be imposed. In assessing the amount of civil
     2  penalty, the department shall determine if there are any
     3  circumstances which mitigate the violation.

     5     Section 2.  This act shall take effect in 60 days.
