AN ACT 1 Amending the act of November 22, 1978 (P.L.1166, No.274), 2 entitled "An act establishing the Pennsylvania Commission on 3 Crime and Delinquency, providing for its powers and duties 4 establishing several advisory committees within the 5 commission and providing for their powers and duties," 6 further providing for the composition and duties of the 7 Pennsylvania Commission on Crime and Delinquency and the 8 composition of the Juvenile Advisory Committee. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. Section 2(b) of the act of November 22, 1978 12 (P.L.1166, No.274), referred to as the Pennsylvania Commission 13 on Crime and Delinquency Law, amended April 30, 1986 (P.L.125, 14 No.38), is amended to read: 15 Section 2. Pennsylvania Commission on Crime and Delinquency. 16 * * * 17 (b) Composition.--The commission shall consist of the 18 following members: 19 (1) The Attorney General. 20 (2) The Chief Justice of Pennsylvania.
1 (3) The Court Administrator of Pennsylvania. 2 (4) A judge of a court of common pleas. 3 (5) Commissioner of State Police. 4 (6) The chairmen of the House and Senate Majority 5 Appropriations Committees. 6 (7) The chairman of the Juvenile Advisory Committee. 7 (8) Four members of the General Assembly, of whom one 8 shall be designated by, and serve at the pleasure of the 9 President pro tempore of the Senate, one by the Minority 10 Leader of the Senate, one by the Speaker of the House of 11 Representatives and one by the Minority Leader of the House 12 of Representatives. 13 (9) Four members appointed by the Governor, one 14 representative of local law enforcement agencies, one 15 representative of adult correctional rehabilitative agencies, 16 one representative of local elected officials and one district 17 attorney representative. 18 (10) Seven private citizens appointed by the Governor, 19 at least two of which serve on the Juvenile Advisory 20 Committee. 21 (11) Secretary of Corrections. 22 (11.1) Secretary of Public Welfare, or his designee. 23 (11.2) Secretary of Education, or his designee. 24 (11.3) Chairman of the Juvenile Court Judges' 25 Commission. 26 * * * 27 Section 2. Section 3 of the act is amended by adding a 28 paragraph to read: 29 Section 3. 1 * * * 2 (17) To serve as the primary State agency for planning, 3 policy development and coordination of the juvenile justice 4 system. 5 Section 3. The act is amended by adding a section to read: 6 Section 3.1. Long-range plan. 7 (a) Development of plan.--The commission, with the 8 assistance of the Juvenile Advisory Committee, shall prepare a 9 long-range, comprehensive juvenile justice plan based on the 10 Commonwealth's needs. The plan shall include recommendations for 11 planning, policy development and coordination for the juvenile 12 justice system. 13 (b) Implementation and monitoring.--Upon the adoption of a 14 long-range plan, the commission, with the assistance of the 15 Department of Public Welfare and the Juvenile Court Judges' 16 Commission, shall develop a strategy for implementing, 17 monitoring and updating the plan. 18 (c) Annual report.--The commission shall annually submit a 19 report to the General Assembly on the status of the long-range 20 plan, including recommendations for legislative action necessary 21 to implement the plan. 22 Section 4. Section 6 of the act, amended December 17, 1981 23 P.L.429, No.134), is amended by adding a subsection to read: 24 Section 6. Juvenile Advisory Committee. 25 * * * 26 (c.1) Additional members.--In addition to the appointed 27 members of the committee, the Deputy Secretary for Children, 28 Youth and Families within the Department of Public Welfare, or 29 his designee, and the Executive Director of the Juvenile Court 30 Judges' Commission shall serve as members of the committee. 19970S0090B0088 - 3 -
