                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for suspension of driver's
     3     privileges for minors convicted of terroristic threats.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 2706 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 2706.  Terroristic threats.
     9     (a)  Offense defined.--A person is guilty of a misdemeanor of
    10  the first degree if he threatens to commit any crime of violence
    11  with intent to terrorize another or to cause evacuation of a
    12  building, place of assembly, or facility of public
    13  transportation, or otherwise to cause serious public
    14  inconvenience, or in reckless disregard of the risk of causing
    15  such terror or inconvenience.
    16     (b)  Restitution.--If the building, place of assembly or
    17  facility of public transportation is owned or occupied by a

     1  school district, the person convicted of violating this section
     2  shall, in addition to any other sentence imposed, be sentenced
     3  to pay the school district restitution in an amount equal to the
     4  cost of the evacuation, including, but not limited to, the
     5  transportation of students and staff from the building, place of
     6  assembly or facility.
     7     (c)  Preservation of private remedies.--No judgment or order
     8  of restitution shall debar the school district, by appropriate
     9  action, to recover from the offender as otherwise provided by
    10  law, provided that any civil award shall be reduced by the
    11  amount paid under the criminal judgment.
    12     (d)  Offenses by minors.--Whenever a person who is under 21
    13  years of age is convicted, adjudicated delinquent or admitted to
    14  a preadjudication program for a violation of subsection (a), the
    15  court, including a court not of record if it is exercising
    16  jurisdiction pursuant to 42 Pa.C.S. § 1515(a) (relating to
    17  jurisdiction and venue), shall order the operating privilege of
    18  the person suspended. A copy of the order shall be transmitted
    19  to the Department of Transportation. The duration of suspension
    20  shall be in accordance with the provisions of section 6310.4
    21  (relating to restriction of operating privileges).
    22     Section 2.  This act shall take effect in 60 days.
