AN ACT
1 Placing a moratorium on licensure or certification on certain
2 health care facilities by the Department of Health.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. Moratorium on licensure or certification.
6 The Department of Health shall neither license or certify any
7 long-term care facility, nursing home, skilled nursing facility
8 or skilled nursing facility in an acute care hospital, nor shall
9 the department survey any rehabilitation unit in an acute care
10 hospital for a period of 18 months or until the department
11 promulgates new regulations for the licensure or certification
12 of such facility or unit, whichever is later.
13 Section 2. Expansion of capacity.
14 Nothing in this act shall prohibit a currently licensed or
15 certified facility or unit from increasing its bed capacity by
16 10 beds or 10% of its present capacity.
17 Section 3. Effective date.
1 This act shall take effect immediately.
