AN ACT
1 Amending the act of November 26, 1978 (P.L.1309, No.317),
2 entitled "An act regulating the awarding and execution of
3 certain public contracts; providing for contract provisions
4 relating to the retention, interest, and payment of funds
5 payable under the contracts; and repealing inconsistent
6 acts," further providing for list of bidders.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Section 2 of the act of November 26, 1978
10 (P.L.1309, No.317), referred to as the Public Works Contract
11 Regulation Law, is amended by adding a subsection to read:
12 Section 2. Time for awarding contracts; list of bidders.

14 (c) A bidder who has been found to be a responsible bidder
15 by the public body and who is a local resident and at the time
16 the bid is submitted provides to the public body proof of the
17 payment of such sales and use taxes imposed on materials used
18 for construction of not less than $5,000 for each consecutive
19 12-month period for 60 months immediately preceding the
1 submission of the bid shall be deemed to have submitted a better
2 bid than a competing contractor who has not provided proof of
3 the payment of those taxes if the amount of the bid is not more
4 than 5% higher than the amount bid by the out-of-State competing
5 contractor.
6 Section 2. This act shall take effect in 60 days.
