AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," further providing for special 6 education payments to school districts; and providing for an 7 aid ratio guarantee. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. Section 2509.5 of the act of March 10, 1949 11 (P.L.30, No.14), known as the Public School Code of 1949, is 12 amended by adding a subsection to read: 13 Section 2509.5. Special Education Payments to School 14 Districts.--* * * 15 (p) During the 1998-1999 school year, each school district 16 shall be paid: 17 (1) An amount to be determined by multiplying fifteen 18 percent (15%) of its school-age average daily membership by one 19 thousand one hundred seventy-three dollars ($1,173). 20 (2) An amount to be determined by multiplying one percent
1 (1%) of its school-age average daily membership by thirteen 2 thousand seven hundred nineteen dollars ($13,719). 3 Section 2. The act is amended by adding a section to read: 4 Section 2509.12. Aid Ratio Guarantee.--During the 1998-1999 5 school year and each school year thereafter, the Commonwealth 6 shall pay to each school district the greater of: 7 (a) the Commonwealth payments to the school district 8 pursuant to section 2509.5 during the prior school year; 9 (b) the amount due the school district under section 2509.5; 10 or 11 (c) the product of: 12 (1) the district's market value/personal income aid ratio 13 reported by the Department of Education for the current school 14 year or .5000, whichever is greater; and 15 (2) the district's expenditures on special education 16 programs in the school year three (3) years before the year for 17 which these payments are to be made. For the calculation under 18 this subsection, a district's expenditures on special education 19 programs shall be: 20 (i) For each school district belonging to an intermediate 21 unit, the boundary of which is not coterminous with that of the 22 district, the amount reported for function code 1200-000 on its 23 Annual Financial Report (PDE-2057) as certified by the 24 Department of Education on the date the Commonwealth's budget is 25 enacted for that school year. 26 (ii) For each school district belonging to an intermediate 27 unit, the boundary of which is coterminous with that of the 28 district, the amount reported by the intermediate unit as "Total 29 Available for Instruction" on its Final Expenditure Report-- 30 Special Education Programs (PDE-2115) as certified by the 19980H2190B2886 - 2 -
